The INDONESIAN (JAKARTA) — The family and legal team of Komang Ani Susana have voiced objections to the criminal proceedings currently implicating her, after she previously prevailed in a civil dispute over land ownership, all the way up to the cassation and judicial review levels.

According to family members, the legal battle over the land, which began in 2012, resulted in a legally binding ruling that confirmed her ownership rights to the disputed land parcel.

However, once the civil case concluded, Komang Ani was instead named a suspect and detained over allegations of using falsified documents.

Her legal representatives argue that the criminal case is inseparable from the history of the land dispute — a matter that had already been thoroughly examined during civil proceedings, from the district court level up to the Supreme Court.

Based on statements from her legal team, the documents now under scrutiny in the criminal case had previously been submitted and reviewed as evidence during the civil trial, and were never deemed problematic in the final, legally binding verdict.

The family has outlined several points they believe require attention in the handling of this case:

– Komang Ani is recognized as the winning party in the civil case, including at the cassation and judicial review stages.
– According to an internal supervisory document cited by the family, sufficient evidence has not yet been found to support the alleged criminal charge of using falsified documents.
– The family states that the documents in question were issued through official village administrative procedures, at a time when the relevant officials were still actively performing their administrative duties.
– They add that these documents were already used and verified during the civil trial, and were never declared to be forgeries.
– The family considers there to be unequal treatment under the law, noting that the officials who issued the documents have not been named as suspects.

Komang Ani’s legal team has also filed a request for a suspension of her detention, citing her age and health condition.

Furthermore, the family says they question settlement offers that emerged after her detention. According to their account, one proposal valued the land compensation at approximately Rp5 million per square meter, with payments to be made in installments. In contrast, they refer to a value reflected in the civil court ruling of around Rp30 million per square meter for the disputed land. This account represents the family’s perspective and has not yet been tested in further legal proceedings.

The family notes that their struggle to defend land rights has lasted more than 12 years. They express hope that all ongoing legal processes will be conducted objectively and transparently, while respecting the authority of court rulings that have already acquired permanent legal force.

“We hope for legal certainty and protection for the rights of citizens. When a ruling is final and binding, all subsequent legal steps must take into account the facts and legal considerations that have already been examined and established in court,” the family stated.
