APKOMINDO Conflict Heats Up: Dozens of Legal Cases and Allegations of Criminalization Uncovered

The INDONESIAN(Jakarta) – The internal conflict involving the Indonesian Computer Entrepreneurs Association (APKOMINDO) has entered its 15th year since first emerging in 2011. What began as a dispute over the freezing of the association’s leadership has now developed into a lengthy series of cross-jurisdictional legal cases that continue to unfold as of 2026.

The issue originated from a 2011 decision by APKOMINDO’s Advisory Council (Dewan Pertimbangan Asosiasi/DPA) to freeze the executive board (DPP) of APKOMINDO for the 2008–2011 term, including Chairman Suhanda Widjaja, Secretary-General Setyo Handoyo, and Treasurer Thedy Suyanto.

This decision led to a lawsuit in 2013 under Case No. 479/PDT.G/2013/PN.JKT.TIM at the East Jakarta District Court. The ruling also noted the establishment of a Caretaker DPP APKOMINDO by the DPA through Decree No. 06/SK-DPA/10/2011 dated October 22, 2011.

Since then, the conflict has continued to escalate. At least 37 legal cases have been recorded, covering civil, criminal, commercial, pre-trial, and state administrative disputes across various courts, including at the cassation and review levels in the Supreme Court of the Republic of Indonesia.

Beyond the judiciary, the conflict has also involved multiple police reports. In one instance, Ir. Soegiharto Santoso (Hoky) was detained for 43 days. During a criminal trial at the Bantul District Court, witness testimony emerged regarding allegations that funds were prepared to criminalize Hoky.

Given the complexity of the cases and the long duration of the conflict, this dispute is deemed potentially eligible for recognition in the Indonesian World Records Museum as one of the professional organization conflicts with the most legal cases and longest duration in Indonesia.

As of 2026, the conflict shows no signs of ending. A new cassation petition has been recorded in the Supreme Court system, related to a case from the Jakarta State Administrative Court (PTUN Jakarta). The petition was filed by Rudy Dermawan Muliadi, who previously claimed to be the Chairman of DPP APKOMINDO in Case No. 212/G/2025/PTUN.JKT.

The defendants include the DPP APKOMINDO led by Ir. Soegiharto Santoso (Hoky) along with Secretary-General Puguh Kuswanto, as well as the Minister of Law of the Republic of Indonesia as an interested party.

Amid the ongoing legal process, Hoky revealed allegations of systematic legal engineering. This has prompted his team to investigate a number of documents, including the Jakarta DKI APKOMINDO Founding Deed No. 43 dated January 15, 2015.

The investigation found alleged factual inconsistencies in the deed, which lists 18 names as founders. Based on this, Hoky and Puguh Kuswanto have issued a formal notice (somasi) to the relevant parties.

Eleven of the 18 individuals have expressed willingness to help uncover the facts, with some stating they were unaware of the deed’s existence. Meanwhile, the remaining seven have yet to respond by the specified deadline.

Hoky emphasized that this transparency in information is part of the commitment to public accountability, as well as an effort to promote legal certainty.

“We believe that truth cannot ultimately be concealed by any process. It may take a long time, but in the end, truth will find its own way, and every party will be held accountable,” said Hoky.

He also stated that this lengthy experience became a turning point in his life, leading him to pursue a career in law as an advocate and establish a law firm and legal organization focused on information technology.

By disclosing the full chronology of the conflict, it is hoped that the public can understand the issue objectively and recognize the importance of the rule of law in resolving complex and prolonged organizational disputes.
